Eligibility

You must be at least 18 years old to use the Service. The Service is designed for building projects in the United States, and Permit Advisor works only for project locations in the United States.

Your Account

You must give accurate information when You create Your Account and keep it up to date. You can sign in with an email address and password or with Google.

Each Account belongs to one person or organization. You may let people in Your own organization use Your Account, but You are responsible for everything done under it and for keeping its sign-in details secure. Tell Us right away at support@permitful.com if You believe someone has used Your Account without permission.

Plans and Payment

Free plan

The free plan includes one active project and one Permit Advisor run, with no payment details required. We may change what the free plan includes, and will tell You before a change that affects Your Account.

Pro Subscriptions

A Subscription unlocks unlimited projects and Permit Advisor runs, Public Dashboards and the Calendar Feed. It is billed in advance, monthly or yearly, at the price shown on Our pricing page when You subscribe, and it renews automatically at the end of each billing period until You cancel it. There is no free trial: billing starts on the day You subscribe.

Payments are processed by Stripe. By subscribing, You authorize Us, through Stripe, to charge Your payment method for each billing period. We do not receive or store Your full card number.

Failed payments

If a renewal payment fails, Pro features are paused until it is paid. Stripe may retry the payment and email You about it, and if it cannot be collected Your Subscription may be cancelled.

Cancelling

You can cancel at any time from Settings → Billing. Cancelling stops the next renewal. You keep Pro until the end of the period You have paid for.

When a Subscription ends

Your Account returns to the free plan and Your Content is kept. While You are on the free plan:

  • Your Public Dashboards are paused. Visitors see a notice that the dashboard is paused and are asked to contact You. The links stay the same and work again if You subscribe again.
  • The Calendar Feed stops listing events.
  • You cannot create or un-archive projects beyond the free plan's limit, and You cannot run Permit Advisor once the free run has been used.
  • Archived projects are read-only. You can view and delete them but not edit their permits or milestones.

Price changes

We may change Subscription prices. We will email You at least 30 days before a new price applies to You, and it will apply from Your next renewal. If You do not want to pay the new price, cancel before then.

Refunds

Subscription fees are non-refundable, except where the law requires a refund. We may grant other refund requests at Our discretion.

Your Content

You own Your Content. You give Us permission to host, store, copy, process, transmit and display it only as needed to provide, secure and improve the Service and to do what You ask the Service to do, for example to show a Public Dashboard You publish, to fill Your Calendar Feed, or to send a project's details to Permit Advisor's providers as described in Our Privacy Policy. This permission ends when You delete the Content, except for copies kept in backups for a limited time.

Your Content often includes information about other people and places, such as Your clients and their properties. You are responsible for having the right to enter that information in the Service and to share it through Public Dashboards and the Calendar Feed.

We take reasonable steps to protect Your Content against loss, but We cannot guarantee that it will never be lost or damaged. Keep Your own copies of records You must retain, such as permits and agency correspondence.

Public Dashboards and the Calendar Feed

A Public Dashboard can be viewed without signing in by anyone who has its link, including people Your recipients forward it to. Public Dashboards ask search engines not to index them, but We cannot prevent a link from being shared. Our Privacy Policy lists what a Public Dashboard shows. You decide who receives the link, and You can make the project private again at any time.

Anyone who has Your Calendar Feed link can read it, including milestones You have marked private. Keep the link to Yourself, and reset it in Settings → Calendar if it may have been shared.

Permit Advisor

Permit Advisor suggests permits a project may need, based on the information You provide and publicly available sources, using automated tools including artificial intelligence. Suggestions, including the permits, issuing agencies, likelihoods and sources shown, are provided for informational purposes only and may be incomplete, inaccurate or out of date. Permit Advisor does not guarantee that it identifies every permit, approval or inspection a project requires.

Suggestions are not legal, regulatory, code-compliance or other professional advice, and do not replace confirmation with the agencies having jurisdiction over Your project. You decide which suggestions to add to a project, and You remain solely responsible for identifying, applying for and obtaining every permit, approval and inspection Your project requires.

To the maximum extent permitted by applicable law, the Company is not liable for any loss, fine, penalty, delay, stop-work order or other consequence arising from reliance on Permit Advisor, or from any permit it did or did not suggest.

Acceptable Use

You agree not to:

  • use the Service for anything unlawful;
  • enter Content that You do not have the right to use, that infringes someone else's rights, or that is defamatory, harassing or obscene;
  • upload or link to malware, or try to disrupt or overload the Service;
  • access or try to access accounts, data or parts of the Service You are not authorized to use, or probe or bypass its security or CAPTCHA checks;
  • get around plan limits, for example by creating extra Accounts to get more free Permit Advisor runs;
  • scrape the Service or use automated tools to access it, other than through features We provide, such as the Calendar Feed;
  • resell or sublicense the Service, or impersonate any person or organization.

We may remove Content that breaks these Terms and may suspend or close an Account that does.

Copyright Complaints

If You believe Content in the Service infringes Your copyright, email Our copyright agent at support@permitful.com with the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)):

  • Your physical or electronic signature, as the copyright owner or a person authorized to act for the owner;
  • the copyrighted work You believe has been infringed;
  • the URL or other location in the Service of the material You believe infringes it;
  • Your address, telephone number and email address;
  • a statement that You believe in good faith that the use is not authorized by the copyright owner, its agent or the law; and
  • a statement, under penalty of perjury, that the information in Your notice is accurate and that You are the owner or authorized to act for the owner.

You may be liable for damages, including costs and attorneys' fees, if You misrepresent that material is infringing.

Our Intellectual Property

The Service, including its software, design and text (but not Your Content), belongs to the Company and its licensors. You may not use the Permitful name or logo without Our written permission.

If You send Us feedback or suggestions, We may use them without any obligation to You.

Third-Party Services

The Service relies on services from other companies, such as Google (sign-in and address suggestions) and Stripe (payments), whose own terms apply when You use them. The Service also links to websites We do not control, including the government pages Permit Advisor cites. We are not responsible for their content or practices.

Ending Your Use of the Service

You can delete Your Account at any time from Settings → Profile. Deleting it is permanent and removes Your projects, permits, milestones and Public Dashboards. It also cancels any Subscription immediately, without a refund for the rest of the period You have paid for.

We may suspend or close Your Account if You break these Terms, if required by law, or to protect the Service or other people. Where reasonable, We will tell You first. We may also change or discontinue features of the Service.

The sections on Your Content, Permit Advisor, disclaimers, limitation of liability and disputes continue to apply after Your Account ends.

Disclaimer

The Service is provided "as is" and "as available". To the maximum extent permitted by law, the Company disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Service will be uninterrupted, error-free or secure, that it will meet Your requirements, or that information in it (including permit statuses, dates and Permit Advisor suggestions) is accurate or complete.

Limitation of Liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from or related to the Service, even if We were told they were possible.

To the maximum extent permitted by law, the Company's total liability for all claims related to the Service is limited to the greater of the amount You paid Us in the 12 months before the claim arose and 100 US dollars.

Some states do not allow these exclusions or limitations, so some of them may not apply to You.

Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If You have a dispute with Us, please contact Us first so We can try to resolve it informally. If it is not resolved within 30 days, either party may bring it in the state or federal courts located in San Diego County, California, and both parties consent to their jurisdiction. If You are a consumer whose local law gives You rights that these Terms cannot take away, those rights still apply.

Changes to These Terms

We may update these Terms. If a change is material, We will tell You by email or in the Service at least 30 days before it takes effect. Other changes take effect when they are posted here, with a new "Last updated" date. If You keep using the Service after a change takes effect, You accept the updated Terms. If You do not accept them, stop using the Service and delete Your Account.

General

These Terms and the Privacy Policy are the entire agreement between You and the Company about the Service. If a court finds any part of them unenforceable, the rest stays in effect. Not enforcing a right is not a waiver of it. You may not transfer these Terms without Our consent. We may transfer them to anyone who takes over the Service.

You confirm that You are not located in a country subject to a United States embargo and are not on any United States list of prohibited or restricted parties. If You are a U.S. federal government end user, the Service is a "commercial item" as defined at 48 C.F.R. § 2.101.
